NOTICE TO VOTERS OF DATE AFTER WHICH NO ARGUMENTS FOR OR AGAINST A CITY MEASURE MAY BE SUBMITTED TO THE CITY CLERK

Rent Stabilization Act

 

NOTICE IS HEREBY GIVEN that at the Consolidated Municipal Election to be held in the City of Alameda on Tuesday, the 8th day of November, 2016, the following Measure is to be voted on:

 

City of Alameda Measure: Shall the voters adopt the City’s March 31, 2016 Rent Stabilization Ordinance, which (a) limits residential rent increases to once annually, (b) requires mediation for all residential rent increases above 5%, including binding decisions on rent increases for most rental units, (c) restricts reasons for evictions, (d) requires landlords to pay relocation fees when terminating certain tenancies, and (e) permits the City Council to amend the ordinance to address changing concerns and conditions?

 

NOTICE IS FURTHER GIVEN that pursuant to Article 4, Chapter 3, Division 9 of the Elections Code of the State of California, that the City Council, or any member or members thereof authorized by the City Council, or any individual voter or bona fide association of citizens, or any combination of voters and associations, may file a written argument not to exceed 300 words in length, accompanied by the printed name(s) and signature(s) of the author(s) submitting it, or if submitted on behalf of an organization, the name of the organization and the printed name and signature of at least one of its principal officers who is the author of the argument, for or against the City measure.  No more than five authors’ names shall appear with any argument.

 

NOTICE IS FURTHER GIVEN that, based upon the time reasonably necessary to prepare and print the arguments and sample ballots for the election, the City Clerk has fixed Thursday, August 18, 2016, at 6:00 p.m. as the date after which no arguments for or against the City measure may be submitted to the City Clerk for printing and distribution to the voters as provided in Elections Code Article 4.  Arguments shall be submitted to the City Clerk at City Hall, 2263 Santa Clara Avenue, Room 380, Alameda, California 94501 accompanied by the printed name(s) and signature(s) of the author(s) submitting it, or if submitted on behalf of an organization, the name of the organization and, and the printed name and signature of at least one of its principal officers who is the author of the argument.  A Declaration by Author(s) Form, available from the City Clerk, Room 380, City Hall, 2263 Santa Clara Avenue, Alameda.  Arguments may be changed or withdrawn by their proponents until and including the date fixed by the City Clerk.  If more than one argument for or against the measure is submitted, the City Clerk shall select one of the arguments for and one of the arguments against the measure, in accordance with Elections Code Section 9287.

 

NOTICE IS FURTHER GIVEN that the City Council has determined that rebuttal arguments, not to exceed 250 words in length, as submitted by the author(s) of the opposing direct arguments, may be filed with the City Clerk, accompanied by the printed name(s) and signature(s) of the author(s) submitting it, or if submitted on behalf of an organization, the name of the organization, and the printed name and signature of at least one of its principal officers who is the author of the argument.  When the City Clerk has selected the arguments for and against the measure, a copy of the argument against the measure will be sent to the author(s) of the argument for the measure and the argument for the measure will be sent to the author(s) of the argument against the measure.  Rebuttal arguments must be filed in the Office of the City Clerk, City Hall, Room 380, 2263 Santa Clara Avenue, Alameda, CA, no later than 6:00 p.m. on Thursday, August 25, 2016.

 

NOTICE IS FURTHER GIVEN that any ordinance, impartial analysis or direct arguments filed under the authority of the Elections Code will be available for public examination in the Clerk’s office for not less than 10 calendar days from the deadline for the filing of the arguments and analysis.  Any rebuttal arguments filed under the authority of the Elections Code will be available for public examination in the Clerk’s office not less than 10 calendar days from the deadline for filing rebuttal arguments.  Copies of the measure are available in the Office of the City Clerk.
