Reclaiming Vessels from the Nelson's Marine Yard

 

The City has established a process by which boat owners will soon be able to reclaim their property from the Nelson’s Marine yard. These procedures will allow people to access their property while addressing concerns over derelict vessels being released into the bay. The City has also identified and pre-approved companies that will be available for boat owners to lift and/or transport their vessels off the premises.

 

To Claim Any Property, you must

  • Provide the City in advance with a list of the property you are claiming and retrieving
  • Sign and return a turnover agreement
  • Have a valid photo ID

Before anything can be taken away, the City will check off and photograph all items.

 

To Claim a Seaworthy Vessel, you must

  • Provide the City with a recent DMV or Coast Guard printout demonstrating that you are the owner of the vessel and confirming that there are no liens or competing claims of ownership of the vessel
  • Provide proof of insurance for the boat
  • Provide proof of current registration for the boat
  • Sign a turnover agreement
  • If you use any boatlift-operating company other than the one pre-approved by the City, that company must provide insurance, including insurance covering the operation of the boatlift that company intends to use, and sign the City’s property access agreement

In addition, the City will determine whether we believe your vessel is seaworthy. If City representatives have any doubts, owners will be informed and the US Coast Guard will be asked to inspect the boat to determine whether or not it can go in the water. Vessels that are deemed “not seaworthy” by the Coast Guard must be trucked off the property. The yard will not be available for boat owners to work on their boats.

 

To Truck a Vessel off the Premises, you must:

  • Provide the City with a recent DMV or Coast Guard printout demonstrating that you are the owner of the vessel and confirming that there are no liens or competing claims of ownership of the vessel
  • Sign a turnover agreement
  • Provide the City’s legal representative with authorization for the trucking company to remove the vessel off the premises
  • If you use any trucking company other than those pre-approved by the City, that company must provide insurance and sign the City’s property access agreement

A form of the turnover agreement that will need to be completed and signed is attached for reference, along with a form of the property access agreement any other company hired by a customer will need to complete, which includes the insurance requirements for that company.
